China Trademark registration
Trademark registration is the precondition for trademark user to obtain an exclusive right. A trademark that has been approved and registered by the authorities, shall be protected by law. Trademark registration is the basic principle to determine the trademark exclusive right. Nowadays, the brand awareness of enterprises and consumers in China are growing. If enterprises want to do brand promotions or open online shops, the relevant business plan cannot be carried out without their own trademark registration certificates. So trademark registration has become an important concern for Chinese and foreign investors.
1.Trademark initial checking
Materials required:
1) The logo to be registered (by jpg. is fine);
2) Information of application (including contact person, phone number, and company name and so on).
Time of initial checking: 1 working day.
2. Trademark Registration
Material required for domestic company:
1) Copy of applicant’s business license;
2) Clear logo picture to be registered;
3).Trademark Classes
4) Power of attorney for trademark registration, need original seal or signature of applicant.
Material for overseas company:
1) Copy of applicant’s business certificate
2) Chinese translation of above-mentioned documents;
3) Clear logo to be registered;
4) Classes of goods;
5) Power of attorney for trademark registration, need original seal or signature of applicant.
The trademark registration processes is :
1. Initial checking
Please send us your trademark with trademark class ( or let us know what area you want it to be protected) for initial checking to see if possible to be registered in China ? Just try to lower the registration risk.
2. Sign contract with payment to start registration process if ok;
3. Make legal docs to get your signatures or chops;
4. Officially submit application for your trademark registration.
5. It will take 2~4 months to get initial acceptance notification on your application.
6. Then go to official checking which will take 1-1.5 years to get next approval for official public announcement or being rejected;
7. If go to official trademark announcement and there is no query from any 3rd party within 3 months,you may get final TRADEMARK CERTIFICATE in following 3-5 months.
